In this Article, I assess James E. Fleming’s Fidelity to Our Imperfect Constitution. For Moral Readings and Against Originalisms. For that purpose: in Part II, I reexamine Ronald Dworkin’s “moral reading”; in Part III, I reevaluate Fleming’s argument both “for moral readings and against originalisms”, which can be characterized as “fidelity to our imperfect constitution”; in part IV, I explicit three very helpful dichotomies to distinguish between moral readings, originalisms and legal pragmatism aka living constitutionalism: (1) fidelity and anti-fidelity; (2) (...) interpretation and non-interpretation aka (re)construction, (re)invention and (judicial) legislation; and (3) perfectionimperfection. Additionally, I reintroduce Lon L. Fuller’s distinction between “intelligent and unintelligent fidelity”, to point out the kind of fidelity that moral readers and everyone else must adopt: an intelligent fidelity; and, finally, I present my general conclusion. Miguel A. De La Torre rejects hope as the ethical basis for a politically effective and truly liberative form of solidarity. Kelly Brown Douglas, on the other hand, articulates a critical retrieval of hope emphasizing the interpretive relationship between the cross, the lynching tree, and the resurrection. Reading De La Torre and Douglas’s works through Natalie Carnes’s theological aesthetics suggests that their respective works can be engaged as “iconoclasms of fidelity,” or the salutary breaking of idolatrous images toward recovering faithful (...) ones. Examining #SprayTheirNames murals that were created in response to state violence against Black people in the United States, I argue that Carnes’s aesthetics framework holds the violence of the crucifixion and promise of resurrection in visual tension, thus decrying violent oppression while offering a beautiful and dangerous memory that catalyzes hope-filled movement in defense of Black lives. Revisiting the influence of Hans Kelsen in Mexico requires a revision not only of his visits to Mexico and of the Mexicans to him, but also the different accounts of his thought that exist in Mexico. Hence, we commence by remembering his visits to Mexico —from the cancelled to the consummated, including a endless lists of invitations to visit the country; we continue with the visits of the Mexicans to Kelsen; and we conclude with a visit to Kelsen in Mexico, (...) where we proceed to review the bibliography published both of and on him in Mexico or of Mexican authors. For that purpose, I will do a brief recount of his published works and of the existing debates regarding the extent of influence of his thought —or the fidelity of both kelsenians and antikelsenians. In this paper, we argue that there are epistemic norms on evidence-gathering and consider consequences for how to understand epistemic normativity. Though the view that there are such norms seems intuitive, it has found surprisingly little defense. Rather, many philosophers have argued that norms on evidence-gathering can only be practical or moral. On a prominent evidentialist version of this position, epistemic norms only apply to responding to the evidence one already has. Here we challenge the orthodoxy. First, we argue that (...) there is no significant normative difference between responding to evidence you have and gathering more evidence. Second, we argue that our practices of epistemically criticizing agents for their poor evidence-gathering indicate the existence of epistemic norms on evidence-gathering. Finally, we show that our thesis has important implications for recent debates about the relationship between epistemic norms and inquiry. (shrink)

Delusions are standardly defined as attitudes that are not amenable to change in light of conflicting evidence. But what evidence do people with delusion have for and against it? Do delusions really go against their total evidence? How are the answers affected by different conceptions of evidence? -/- This chapter focuses on how delusions relate to evidence. I consider what delusions-relevant evidence people with delusions have. I give some reasons to think that people typically have evidence for their delusions, and (...) that the evidence they have against them is often overstated. I draw on this discussion to consider whether delusions are evidentially supported and epistemically rational. Finally, I discuss implications for the nature of delusion, responsibility, and treatment and suggest directions for future research. Throughout, the discussion is sensitive to different conceptions of evidence and rationality in epistemology. -/- A central upshot is that what we should say about the epistemic standing of delusions depends substantively on our positions in epistemology, in particular, on the debate between internalists and externalists about evidence. If we want clarity on the epistemic standing of delusions, we need to incorporate more sophisticated tools from epistemology. (shrink)

Commentary on Pablo Hubacher Haerle’s paper “Is OCD Epistemically Irrational?”. I argue for expanding our assessment of rationality in OCD by considering a wider range of epistemic parameters and how they fit together.

Este texto recupera dos posiciones en torno al concepto de destino: la de Diego de Saavedra Fajardo y la de Plutarco. Ambos, a diferencia de algunos estoicos, sostienen que, independientemente de aquellas circunstancias que escapan a la voluntad humana, el hombre posee la capacidad para ser libre y tomar decisiones respecto de sus actos, sin que esto signifique dejar atrás el ideal del sabio. Para ellos, enfrentarse con el destino implica conocer las pasiones que se hallan inmersas en la naturaleza (...) humana, así que no las toman en un sentido negativo. Por esta razón, ambos filósofos insisten en reorientar las pasiones a través de la educación, la moral o la religión y, con ello, en dejar atrás la idea de que el hombre está determinado o bien por su propia naturaleza humana o por las circunstancias que se le presentan. El presente estudio exploratorio centra su investigación en la variación morfológica de los verbos de la segunda conjugación de presente del indicativo en primera persona plural del español de Chile, cuyas realizaciones alternan entre la variante [-emos] e [-imos] en el _Corpus oral Sociolingüístico del Castellano de Chile_ (COSCACH) (Sadowsky, 2021). Nuestro objetivo general es describir la frecuencia relativa de ambas desinencias, en relación con las variables sexo, edad y nivel sociocultural. Mediante un análisis estadístico descriptivo de los datos, establecemos (...) que existe correlación entre la variable morfológica estudiada y las variables extralingüísticas sexo y nivel sociocultural de los hablantes; respecto de la variable etaria, esta no es determinante. También se aprecia un uso muy reducido de la variante [-imos], a favor de [-emos], pese a que la variación morfológica data desde hace más de dos siglos, por lo que podríamos decir que estamos frente a un cambio lingüístico que convendría estudiar en profundidad a partir de una muestra mayor. The article presents some of the results of the research project Lúdica y juego en la educación infantil: construcción conceptual–Play and Games in Early Childhood Education: A Conceptual Construct–financed by the Vicerrectoría de Investigaciones of the Universidad Pedagógica y Tecnológica de Colombia, Tunja, Boyacá, Colombia. The aim was to identify and explore the conceptions of what the Campamento Filosófico (Philosophy Camp) represents for its participants within the framework of the project Filosofía e infancia (Philosophy and Childhood). This study takes a (...) qualitative approach, for which semi-structured interviews were used as an instrument for data collection. Also, Atlas.ti 8® software was used for data analysis. An open, axial and selective coding was carried out, in which the emerging categories of the analysis were “experience,” “encounter,” “learning,” “self-care” and “body”. As a result of this conceptualization, it was found that philosophy camps are scenarios that make possible a relationship between university learning environments and primary, elementary and middle school educational contexts. They also enable an experience of the dialogic encounter between different perspectives on the same philosophical topic. Through the Philosophy Camp, philosophy is brought to the school, and the encounter with childhood - as a state, attitude and possibility - fosters spaces for thought, friendship and interaction. The dominating theologian in Europe between Thomas Aquinas and John Duns Scotus, Henry of Ghent produced a massive Summa of Ordinary Questions as well as fifteen quodlibets during his long tenure at the University of Paris. His work constituted a new synthesis of faith and reason which competed with that of Thomas Aquinas and influenced the history of both philosophy and theology. The first five articles of the Summa, dealing with various issues associated with human knowledge, constitute an adequate introduction (...) to Henry's thought. In them we find his approach to fundamental principles and themes developed in detail in the rest of his corpus. Of the five, only article one has appeared as a whole in English translation. The next four articles reinforce and develop the findings of the first article, providing additional treatments that indicate Henry's principles and orientation. In fact, these four articles alone provide a condensed but remarkably rich portrait of Henry's basic thought, and so are an invaluable resource for beginning and advanced students alike. Articles 2-5 include important positions on knowledge and reality, a conception of humanity's ultimate purpose and the pursuits most conducive to it, and an approach to faith and reason. These four articles are presented here for the first time in English translation with an introduction and notes. This research was carried out in a classroom of the center of comprehensive family development in the municipality of Durango, Mexico. The center trains young people in making crafts. From these young people, 13 teenage mothers ages 15-23, all victims of abuse as children, were selected. With this group, we implemented the philosophical-pedagogical proposal called "Philosophy for children and teenagers," first developed by the American philosopher Matthew Lipman. The main goal was to form a "community of inquiry," where through philosophical (...) dialogue the participants developed cognitive skills, allowing them to share, in an ethical and moral dialogue, their life experiences within a democratic setting. The results were demonstrated through the disclosures made by the participants during the philosophical dialogues, We also recorded the cognitive abilities detected over 20 sessions. We contrast the results with the theories to demonstrate the participants’ cognitive changes. We also observed unexpected findings in other academic fields that facilitate ethical and moral thinking. The aim of this research was to explore the elements that configure the quality of care among three Mexican same-sex planned families: two female-parented families (through donor insemination) and a male-parented one (through adoption). The first family consisted of two mothers and a 3-year-old daughter; the second one had two mothers and a 1.5-year-old set of boy twins and the third family consisted of two fathers and a 2-year-old girl. It was assumed that Ainsworth’s notions of quality of care organization (...) are useful in order to understand caregiver-child attachment relationships, regardless of the parents’ sexual orientation. A collective case study was selected due to the fact that these families shared their “unconventionality” (i.e. parents were not heterosexual) and the fact that they were planned, but each one constituted a particular case with a unique configuration. Four trained independent observers used the q-sort methodology (Maternal Behavior Q-Sort and Attachment Q-Sort) to describe parents’ and children’s behavior, respectively. The findings showed that parents were highly sensitive and all children used them as a secure base. To provide an in-depth examination of which elements configure the quality of care, a semi-structured interview with each parent was carried out. Through a thematic analysis, an over-arching theme named Affections and Emotions was identified, together with six subthemes: 1) Creating an affective environment; 2) Being available; 3) Acknowledging and expressing emotions; 4) Perceiving, interpreting and responding adequately to the child’s real self; 5) Taking the child’s perspective into account; and 6) Agreeing on roles and dividing the tasks. In order to showcase the particular configuration of gay parenting, the male-headed family narrative is reported in detail, because gay parents have been perceived as violating traditional gender roles as well as the hegemonic model of masculinity. The findings were consistent with the notion of quality of care as proposed by Ainsworth and her collaborators. The implications of the methodological device and research regarding same-sex planned families are discussed so as to understand the organization of the caregiving environment. (shrink)

Se presenta una visión de la epistemología como lógica del pensar y se la lleva a una elaboración de la práctica clínica como una lógica del padecimiento psíquico. Esto basado en los planteamientos de Deleuze y Guattari. Para ello se toma como punto de partida la noción de los movimientos aberrantes que, leyendo la obra de Deleuze, elaboró David Lapoujade entendiéndolos como movimientos que se producen en la relación entre distintos términos heterogéneos, pero manteniendo su heterogeneidad. Esto es vinculado con (...) la invitación que hace el mismo Lapoujade a entender la obra deleuzeana como el desarrollo de lógicas irracionales, intentando pensar desde ahí una lógica de la locura y del padecimiento mental con base en, a su vez, una lógica de las obras literarias de Proust y Kafka, tal como las leen los mismos Deleuze y Guattari. En relación con ello destacamos, por un lado, cierta lógica de conjuntos abiertos y no totalizables que estos últimos autores encuentran en la obra de Proust y, por otro lado, una lógica de la contigüidad que encuentran en la obra de Kafka. Al mismo tiempo, se establecen puntos en común entre estas dos lecturas a propósito de lo esquizoide como algo que excede a la significación del discurso, así como a la normatividad de la conducta. Asimismo, en distintos puntos del escrito se extraerán las implicaciones que estos modos de pensar tienen para una práctica clínica en relación con modos de existencia subjetivos que se escapan a lo que está establecido en el campo social. De esa manera, ponemos en conjunción una aproximación epistemológica con una política. (shrink)

In this article, we explore the heuristic power of the theoretical distinction between framework and interaction theories applied to the case of General Relativity. According to the distinction, theories and theoretical elements can be classified into two different groups, each with clear ontological, epistemic and functional content. Being so, to identify the group to which a theory belongs would suffice to know a priori its prospects and limitations in these areas without going into a detailed technical analysis. We make the (...) exercise here with General Relativity, anticipate its ontological, epistemic and functional content and show afterwords that such expectations are justified in this case, being consistent with formal issues of General Relativity. With this, we attempt to make a case for the use of the distinction as a powerful tool for scientific and philosophical analysis. (shrink)

Structured time (hyle) and its relationship to other elements of physics: matter, energy, space, etc.

Esta investigación se realizó con el objetivo de evaluar el impacto de la pandemia en las expectativas y oportunidades de los jóvenes en la zona metropolitana del Valle de México para seguir estudiando en un contexto de pobreza marcado por la incertidumbre de la COVID-19. El estudio se llevó a cabo con metodología cuantitativa, con alcance descriptivo y correlacional a partir de la definición de tres variables independientes: 1) rango de edad, 2) nivel de estudios, 3) su condición de estudiante; (...) y dos variables dependientes: 1) razón que motiva a los jóvenes a capacitarse; 2) tipo de discriminación. El diseño y análisis fueron trabajados desde teorías sobre pobreza, representaciones sociales y el estado del arte sobre comunicación del COVID-19. Las conclusiones revelan que los jóvenes encuestados encuentran una motivación para aprender en correlación con una mayor preparación; los que poseen estudios universitarios su motivación se centra en mejorar su calidad de vida; mientras que para los de menor nivel de estudios todos los motivos tienen la misma ponderación. En general, las principales motivaciones para aprender se encuentran en el ámbito de la familia, así como influir positivamente en otros. La necesidad de aprender como requisito, para obtener comida o un apoyo económico, y para cuidar de la comunidad, resultan tener la menor frecuencia de motivación, lo que demuestra que las políticas económicas implementadas por el Estado, no han generado las representaciones sociales y culturales suficientes para el progreso integral de las personas. En “Acerca de la pregunta: ¿qué significa ilustrar?” de 1784, Mendelssohn sostiene que la ilustración que está conectada con la vocación esencial (wesentlich Bestimmung) del ser humano en tanto que ser humano puede entrar en conflicto no solo con la moralidad –las vocaciones extra-esenciales (außerwesentlichen Bestimmungen)– sino también con la vocación esencial del ciudadano, esto es, como miembro de un Estado. En estos casos, afirma Mendelssohn, es necesario cierto cuidado y precaución, cierta prudencia (Klugheit), en el uso de la ilustración. (...) El presente trabajo tiene como objetivo analizar el significado de esta apelación a la prudencia, por parte de Mendelssohn, como símbolo de una Ilustración que, en su compromiso radical con la humanidad, propone una aguda indagación sobre la “situacionalidad” de la razón y su poder emancipador, en la compleja interacción entre teoría y práctica. The current predominant conception of human rights implies that human beings have objective intrinsic value. In this paper, we defend that there is no satisfactory justification of this claim. In spite of the great variety of theories aimed at explaining objective intrinsic value, all of them share one common problematic feature: they pass from a non-evaluative proposition to an evaluative proposition by asserting that a certain entity has intrinsic value in virtue of having certain non-evaluative features. This is a step (...) that cannot be justified. In light of this negative result, we offer a radically different approach to intrinsic value. Our proposal reinterprets the claim that human beings have intrinsic value in terms of a commitment to value human beings intrinsically. This commitment provides both objective practical reasons for, and a rational explanation of, efforts aimed at defending and promoting human rights, without need to appeal to the existence of objective intrinsic value. Répondre à cette question est moins simple qu’il n’y paraît et nécessite de relever trois défis : appréhender la connaissance statistique de ce phénomène, comprendre sa dimension politique et, enfin, saisir le contenu juridique des normes nationales et internationales produites dans ce domaine. Cette contribution met en évidence la diversité des approches possibles pour appréhender le sujet, mais aussi les vides juridiques pouvant exister en la matière. BackgroundInformed consent is an important factor in a child’s moral structure from which different types of doctor–patient relationships arise. Children’s autonomy is currently under discussion in terms of their decent treatment, beyond what doctors and researchers perceive. To describe the influential practices that exist among clinicians and researchers toward children with chronic diseases during the process of obtaining informed consent.MethodsThis was a cross-sectional, qualitative study via a subjective and interpretivist approach. The study was performed by conducting semi-structured interviews of 21 (...) clinicians and researchers. Data analysis was performed using the SPSS version 21® and Atlas Ti version 7.0® programs.ResultsThe deliberative and paternalistic models were influential practices in the physician–patient relationship. In the deliberative model, the child is expected to have a moral awareness of their care. The paternalistic model determined that submission was a way of structuring the child because he or she is considered to be a subject of extreme care.ConclusionsThe differentiated objectification [educational] process recognizes the internal and external elements of the child. Informed consent proved to be an appropriate means for strengthening moral and structuring the child. (shrink)

Frente al déficit de visión territorial a escala nacional, que devele el patrón de los conflictos ambientales vigentes en Chile, se propone la construcción de un índice sintético de vulnerabilidad social, con soporte en la unidad de análisis político-administrativa de administración local, junto a la localización de los conflictos ambientales denunciados por ONG’s. Ello posibilitará estudiar la relación espacial existente, de modo de determinar qué perfil de unidades territoriales soportan mayor carga de externalidades negativas generadas por proyectos de inversión privada. Resumen Es muy conocida la opinión de Kant en relación con la inmoralidad del suicidio. De ahí que, muchos autores lo consideren como un prohibicionista absoluto. Sin embargo, no hay hasta el momento un análisis puntual sobre la definición metafísica-conceptual del suicidio en la teoría kantiana. En este artículo propongo entender el suicidio en Kant como una muerte física, total, autorreferencial, voluntaria e inmoral. Esta definición contrastará con la privación de la vida, la cual no implica inmoralidad. Al ser voluntarios, (...) tanto la privación de la vida, como el suicidio son actos racionales y entendibles a partir de las máximas de acción. La inmoralidad del suicidio sólo surgirá al considerar la primacía de las razones morales por encima de razones no morales.It is common knowledge theposition of Kant regarding the immorality of suicide. Several authors attribute him an absolutist-forbidden criterion. Nerveless, there is no extended analysis about the metaphysical-conceptual definition of suicide in Kantian theory. In this paper I hold that suicide in Kant can be defined asphysical death, full, self-referential, voluntary, and immoral. This definition conflicts with the definition of deprivation of life which is not immoral. As voluntarily acts, both suicide and deprivation of life are rational acts that can be understood as maxims of action. The immorality property of suicide is due to the primacy of moral over non-moral reasons. (shrink)
